FEBRUARY 6, 7.7 AND 7.6 EARTHQUAKES - HOW DO EARTHQUAKE COVERAGE IN POLICIES WORK?




On February 6, 2023, an area of 13.5 million people along a 330 km line was shaken by two successive earthquakes. Due to this major disaster, Turkey issued a level 4 alert and called for international assistance. The search and rescue operations, in which all teams and volunteers are taking part, continue with great effort in a very wide area. Due to heavy rains and cold temperatures, the work is being carried out under very difficult conditions.


Those who lived through the earthquake and lost loved ones will be in dire need of all kinds of support. As a society, we will heal the pain and wounds in our hearts together as always.

The extent of the damage caused by the earthquake will be understood in time. The insurance sector will be one of the important supporters in compensating the material and economic damage. All companies are ready to cover the damages as soon as possible.


Earthquake is an additional coverage in insurance policies. To keep it ready at hand, I have briefly summarized how the coverage works in individual and corporate insurance policies that include earthquake coverage.


Important Notes for Individual and Corporate Fixed Asset (Fire) Insurances


Principle of proximate cause - Fire, interior water damages and explosions following the earthquake are also compensated under the earthquake coverage conditions. If earthquake is not covered in the policy, damages due to the realization of risks such as fire and internal water following the earthquake will not be covered by the policy.

72-hour clause - Earthquakes occurring within 72 hours are considered as a single event


Earthquake: Calculation of damage compensation


Earthquake Exemption for Houses

Turkish Catastrophe Insurance Pool (TCIP): 2% exemption is applied on the insurance value - Example - Building Value - 500.000 TL - Exemption amount to be deducted from the compensation in each damage is 10.000 TL


Dwelling Policies - BUILDING - 2% deductible is applied on the insurance value - Example - Building Value - 500.000 TL - Deductible amount to be deducted from compensation in each damage is 10.000 TL


Dwelling Policies - POSSESSIONS % of the total value of the property included in the policy - Property Value TL 300,000 - Deductible amount to be deducted from the indemnity for each loss TL 15,000

Damage compensation is paid after deducting coinsurance and deductible. The insured pays ... (usually 20%) of the damage of the insured's choice - covered by the insured The insurer pays the remaining ... (usually 80%) - min ... (usually 2%) deductible

Example - If the insured's earthquake coverage conditions are 20% of each loss and the insurer pays min 2% (usually 2%) of the remaining 80% of the insured's choice

Building cost 1. 000.000 TL

Calculated damage amount - 600.000 TL

Part of the damage to be covered by the insured - 120.000 TL

Deductible amount to be deducted by the insurer - 16.000 TL

Amount to be deducted from the damage compensation - 136.000 TL

Damage compensation to be paid - 464.000 TL

Life Insurances- Life and personal accident, death and permanent disability are paid provided that earthquake coverage is included.

Health insurances- (Private health, Complementary health) health expenses are paid as a result of the earthquake.

Travel Health Insurances - Earthquake is not covered.


Car Insurance

Traffic Insurance does not cover damages caused by earthquakes

Comprehensive insurance - covers damage to the vehicle if earthquake is included


Housing Insurances TCIP - up to the limit specified in the policy - the calculated damage amount is covered after deducting the exemption.

Housing Insurance - Provided that the building and/or property coverage is included in the policy, the part of the building exceeding the amount in the TCIP policy and the cost of the property is covered after deducting the calculated damage amount exemption. (If it is the first fire insurance, it will cover up to the first fire limit in the policy)

Cell phones, mobile devices - if the earthquake is included, it is paid after deducting the amounts corresponding to the deductible and coinsurance.


CORPORATE INSURANCES

If earthquake is included in your following policies


Fixed Asset (Fire) + Stock Subscription + Loss of Profit Insurances

Physical damages caused by earthquakes are paid according to the indemnity calculations mentioned above

- Damage to your building and machinery, plus special conditions where included;

- Damage to the base of the machines

- Professional consultancy services after damage

- Damages to models and molds

are covered by your policy.


If you have Loss of Profit coverage, after the waiting period specified in the policy, you can benefit from the loss of profit coverage, which is the sum of fixed expenses + net profit, for the indemnity period specified on the policy. If you have Loss of Rent coverage, your rent loss due to earthquake in your commercial buildings rented to third parties will be paid during the indemnity period.


Important! Losses incurred by the public authority due to the disposition of the insured property are not covered under Fixed Assets and Loss of Profit. For example, due to the current earthquake, hotels used for accommodation or hospitals cannot claim for the period when they were unable to operate. Recently, it seems that this exclusion has been included in some policies with limits.


Other compensation paid under Loss of Profit if included in special terms:

- Obstruction of access - lost profits when your facility is inaccessible because of road closures, even though there is no damage due to the earthquake

- Lost profits caused by your critical customer not buying due to earthquake damage

- Loss of profits due to the inability of your critical supplier to supply you with raw materials as a result of earthquake damage

- Interdependency - the loss of profits due to the cessation of production if one of your interdependent businesses is damaged

- Increased labor costs


After deducting coinsurance and deductible amounts, provided that the earthquake is included

  • Machine Breakdown

  • Moving Machinery Comprehensive Comprehensive Insurance

  • Electronic Device

  • Construction & Assembly Insurances and Loss of Profit (ALOP)

are compensated.


Transportation Insurances (provided that there is Truck Clause and All Risk)

Important- In Transportation Insurances- CIF policies, the damage must be within the waiting period at the port. Goods in the final warehouse are evaluated within the scope of Fire Subscription.

Boat Insurances: Earthquake is included

Other Types of Insurance Employer's Liability - Does not pay compensation unless the Employer is given responsibility for the earthquake

Third Party Liability - Earthquake excluded

Mining Compulsory Personal Accident - Earthquake excluded.

Trade Receivables Insurance - paid if covered by an additional contract

Credit Insurance - payable if covered by an additional contract

Agriculture, Greenhouse, Beekeeping, Livestock and Loss of Income Insurances - Earthquake included.
